Türkiye is a leading destination for medical tourism, cosmetic surgery, and advanced surgical treatments, thanks to its experienced doctors and modern hospitals. However, many international patients ask a critical question before traveling: What happens if complications occur after surgery? Who covers the costs?

This concern is well-founded. Under Turkish law, since 2025, mandatory complication insurance provides financial protection for foreign patients if medical complications arise after cosmetic or surgical procedures in Türkiye.

At Vural & Demir Law Firm, we have summarized this regulation in clear terms and explain patients’ rights in Türkiye, how post-surgery complication insurance works, and what international patients must pay close attention to.

1. Who Is Covered by Mandatory Complication Insurance in Türkiye?

1.1. Which Procedures Are Subject to Mandatory Insurance?

Mandatory complication insurance in Türkiye applies, within the scope of medical tourism, to surgical and interventional procedures performed in an operating room.

If you travel to Türkiye for cosmetic surgery, bariatric surgery, or other surgical procedures such as liposuction, gastric reduction surgery, rhinoplasty, or for treatments like dental implants or sinus lift procedures performed in a clinical or hospital setting, you fall under this legal protection. The purpose of this regulation is to financially safeguard patients undergoing higher-risk surgical procedures.

Non-surgical treatments such as Botox or dermal fillers, performed in consultation rooms, as well as procedures carried out in facilities without an operating room license, are not covered. This distinction is decisive in determining whether claims can be made under complication insurance after surgery.

1.2. Who Is Responsible for the Insurance?

One of the most common questions from international patients is:

Do I have to pay for the insurance myself, or does my medical travel agency cover it?

The legal position is clear: The obligation to arrange and pay for mandatory complication insurance lies exclusively with the treating healthcare provider (clinic or hospital). In practice, the insurance premium is often included in the treatment package. Patients should therefore always verify in writing, before surgery, whether the insurance is explicitly listed in the offer or contract.

2. Complications After Surgery in Türkiye vs. Medical Malpractice: When Is a Lawsuit Possible?

2.1. Complication or Medical Malpractice? Why This Distinction Directly Affects Your Claim

One of the key legal challenges for patients traveling to Türkiye for medical treatment is the confusion between medical complications and medical malpractice. These concepts have fundamentally different medical and legal consequences. Whether a patient may pursue an insurance claim or a medical malpractice lawsuit depends entirely on this classification. A wrong assessment may lead to loss of compensation or years of legal proceedings.

2.2. What Is a Medical Complication? (No-Fault Liability)

A complication occurs when a known and accepted risk of a medical procedure materializes despite the surgery being performed correctly and according to medical standards. It is therefore considered a no-fault negative outcome.

Post-operative infections, bleeding, implant displacement, or delayed wound healing are regarded as surgical complications if they are not caused by a specific medical error.

Legally decisive is whether the outcome was unavoidable despite all reasonable precautions taken by a qualified physician. This is why complications are listed in informed consent forms. Mandatory complication insurance is designed to cover the costs of such cases, including revision surgeries, additional treatments, or extended hospital stays.

2.3. What Is Medical Malpractice?

Medical malpractice occurs when a healthcare provider deviates from accepted medical standards and causes harm to the patient through fault, negligence, or error.

Incorrect diagnoses, faulty surgical techniques, incorrect medication dosages, or failure to comply with essential safety protocols are considered malpractice.

This risk has been covered since 2010 by mandatory medical malpractice liability insurance, which covers material and non-material damages as well as legal defense costs.

2.4. The Critical “Gray Area” Between Complication and Malpractice

Complication insurance and malpractice insurance are not alternatives but complementary protection mechanisms. While complication insurance applies without proof of fault, malpractice insurance applies to fault-based liability claims.

In practice, the boundaries often blur. Insurers may shift responsibility: the complication insurer may claim malpractice, while the malpractice insurer may argue an unavoidable complication.

This gray area poses a significant risk for patients. Therefore, pre-operative informed consent forms and complete post-operative medical records are crucial evidence in the hands of a specialized law firm.

At Vural & Demir Law Firm, we analyze each case medically and legally to determine the correct path: fast compensation through complication insurance or a medical malpractice lawsuit in Türkiye. This strategic decision is essential to enforce your rights efficiently and at an appropriate compensation level.

3. How Does Mandatory Complication Insurance Work? Scope, Duration, and Exclusions

3.1. Surgical Complications in Türkiye: How Does Mandatory Complication Insurance Apply?

Although it may appear to be a formal document, mandatory complication insurance is a clearly defined financial insurance contract. For international patients, the key issue is not merely the existence of the policy, but what is covered and what is excluded.

The system is based on no-fault liability. Even in the absence of medical error, the insurance applies to complications arising from the surgical procedure itself.

A standard policy aims to cover the costs of medically necessary follow-up treatments, including revision surgeries, hospital and intensive care stays, medications, and directly related medical services.

3.2. Duration and Territorial Limits of Complication Insurance in Türkiye

Complication insurance coverage is time-limited. Typically, coverage lasts six months from the date of surgery. Some policies exclude early post-discharge complications (e.g. the first seven days) under standard plans, while extended (VIP) plans include this risk. Coverage duration varies depending on the procedure and insurance product. Complications occurring after the policy period are not covered.

Territorially, coverage generally applies only within Türkiye and often only at the treating facility. Treatment in another country or another clinic is usually excluded, although individual policies may contain exceptions.

3.3. Travel and Additional Costs: Are Flights and Accommodation Covered?

For international patients, travel and accommodation costs are also critical. Depending on the policy, mandatory complication insurance may cover not only treatment costs but also return travel to Türkiye for revision surgery.

If re-entry is required due to a complication, economy-class flights and accommodation during treatment may be covered within specified limits. Extended policies may also include costs for an accompanying person or limited treatment in the patient’s home country. Patients should therefore carefully review the “Travel and Assistance Benefits” section of their policy.

3.4. When Does Complication Insurance Not Pay? Key Exclusions After Surgery in Türkiye

Exclusions are decisive. Damages resulting from medical malpractice are not covered by complication insurance and must be pursued through medical liability claims.

Subjective aesthetic dissatisfaction is also excluded. Coverage requires an objectively recognized medical complication, not dissatisfaction with cosmetic results.

Additionally, pre-existing or undisclosed medical conditions, complications arising after policy expiration, and damages caused by failure to follow medical instructions are generally excluded from coverage.

4. Enhanced Rights of International Patients in Türkiye and Informed Consent

Mandatory complication insurance is far more than a bureaucratic requirement for international patients treated in Türkiye. It is a concrete financial protection mechanism against post-treatment risks.

One of the greatest fears of patients abroad is being left alone in case of complications. This insurance directly addresses that concern by covering revision surgeries, additional treatments, and travel and accommodation costs within the policy framework.

A clearly regulated insurance policy defines the legal roadmap in advance. Many disputes in medical tourism arise from uncertainty over who bears additional costs. The insurance eliminates this gray area and reduces interpretational conflicts. Our experience at Vural & Demir Law Firm shows that transparent insurance coverage is the most effective way to avoid lengthy and exhausting litigation and instead reach an amicable solution.

Another key benefit is the strengthening of informed consent. Before surgery, patients clearly understand which risks are covered and which are not—particularly in cosmetic procedures where subjective dissatisfaction is excluded. This realistic framework prevents false expectations and enables informed, confident decision-making.
